
The President and the National Executive Committee of the Performing Musicians Employers Association of Nigeria (PMAN) hereby write to notify the general public of the violation by some unscrupulous elements (not your organization) of the PMAN name and legally registered Trademark. The Performing Musicians Employers Association of Nigeria (PMAN) is the owner of the rights of the Trademark and name which is described in the enclosed attachment.
It has been very brought to our attention that these persons led by Mr. Tee Mac Omatshola, Mr. Chris Mba, one Kestron Okorie and others having been using this and causing confusion. Our registration of this trademark provides us with certain proprietary rights. We are entitled to resist the use of the trademark or a confusingly similar trademark in association with confusingly similar products or services. Our trademark serves as an important and distinctive representation of our union as well as the goodwill of same. We therefore find it imperative to protect it against any misrepresentation that may cause substantial harm to our activities by facilitating the loss of the trademark’s effectiveness. Continued unauthorized use of our legally registered trademark amounts to an infringement of our trademark rights.
We understand that it is very possible that the general public may be unaware of this conflict. Our request to you is not to unknowingly aid the use of this mark as the defaulters have also been notified and legal action already commenced.
